Nillumbik Shire Council has Local Laws in place to help protect the amenity of The Green Wedge.

Burning off
A person must not light a fire in the open air unless for fuel reduction purposes and only in accordance with the following:
Properties less than 0.4 Ha or 1 acre are permitted to burn with a permit, from 1 October until 1 February (or the start of a fire danger period if sooner).
For properties 0.4 Ha and over, fires are allowed without a permit at all times outside the declared fire danger period.
During the declared fire danger period, no burning is allowed.
To obtain a permit and to check the conditions for burning off with or without a permit, please contact Council’s Municipal Laws Section on 9433 3231.
 
Incinerators
An owner or occupier of land must nor permit any incinerator on the land to be lit or to allow such to remain alight.
 
Recreational vehicles
People using recreational vehicles on private land will in all cases require a Local Laws Permit, and this must be obtained prior to using the vehicle on private property.

A recreational vehicle is defined in the local law as any mini bike, trail bike, motor bike, motor car, motor scooter, go-cart and any other vehicle which may be propelled or operated by internal combustion, steam, gas, oil, electricity or any other power and which is normally used for recreational purposes.
 
Advertising cars for sale
Vehicles advertised for sale cannot be parked on Council reserves, nature strips or road.

Municipal Laws Officers conduct regular patrols and issue fines, under Local Law provisions, of $200 for vehicles parked for the purposes of advertising.
 
Abandoned or derelict vehicles
A person must not leave an unregistered vehicle or abandon a vehicle on any road or parking area under the control of the Council or on any Council land.

Vehicles found in this condition may be impounded and sold by Council.
 
Tables and chairs, goods and A-frame signs on Council land
Businesses wishing to place merchandise, signage or eating facilities on Council land require a permit from Council to do so. The Planning Unit should also be contacted to ensure compliance with existing permits.

Criteria for the issuing of permits include obtaining Public Liability insurance for $10 million indemnifying Council in the event of an accident, and submitting a diagram showing the placement of said items.
 
Caravans
Living in a caravan is not permitted in this municipality unless it is in a registered camping area.

Residents who are building on a vacant block may apply for a permit to live in a caravan for up to six months while building works are being undertaken.

Please note that there are conditions under Environmental Health that must also be complied with in relation to run off and sewerage.
 
Keeping more than two dogs and two cats
A permit is required from Council if you would like to keep more than two dogs or two cats on your property. This also applies to properties with more than one residence on them.

Please include a drawing of kennels or enclosures on your property in relation to neighbouring houses and buildings with your application. For an application kit please contact 9433 3231 or click on the link for permit applications above.

All dogs and cats over the age of three months must be registered with Council.
 
Excrement
A person in charge of a dog in a public place must carry a facility for the removal of any excrement that may be deposited by that dog, collect and dispose of any excrement deposited by that dog; and produce the facility to an authorised officer when requested.
 
Secure confinement of animals
An owner or occupier of land on which livestock or dogs are kept must ensure that the land is adequately fenced so as to prevent the escape of such livestock or dogs from the land.

Without a permit a person must not keep any livestock on any residential land of an area less than 4,000 square metres(approx. 1 acre).
 
Control of noisy animals and birds
The occupier of any land where an animal or bird is kept or permitted to remain must not allow the animal or bird to make noises or sounds which may unreasonably adversely affect the peace, comfort or convenience of any persons on any other land.
 
Dogs prohibited in markets
A peron must not permit, cause or allow any dog to be present on any land determined by resolution of the Council from time to time to be a market.
 
Domestic rubbish bins
Please ensure that your rubbish bin/s are brought onto your property within 24 hours of collection. Fines may be issued for those bins which are repeatedly left out.

Overhanging tree branches
Council has maintenance rosters to regularly trim shrubs and trees in public places, however shrubs and trees from private property are the responsibility of the property owner. Please keep a check on any branches that may protrude from your property over footpaths and wallkways.

It can become difficult for pedestrians to utilise our paths when battling with overgrown and sometimes wet foliage.

If your property is at an intersection, check that vegetation does not grow in such a manner that it causes a danger to traffic or drivers by preventing a clear view of other vehicles.
