Fireworks Local Law 2019

Notice is hereby given that Nillumbik Shire Council intends to make the following Local Law under Section 111(1) of the Local Government Act 1989.

TITLE:

Fireworks Local Law 2019

PURPOSE:

The objectives of this Local Law are to:

  • manage and regulate the discharge of fireworks on private land in the municipal district to reduce amenity and environmental impacts of fireworks;
  • address activities with the potential to be a nuisance and impact on the health and wellbeing of residents in a bushfire prone rural environment; and
  • apply standards that address safety matters directed at reducing risk to the community.

GENERAL PURPORT:

Part 1 – Preliminary

This Local Law is the Fireworks Local Law 2019 and is made under Part 5 of the Local Government Act 1989.

This Local Law applies to land outside of the urban growth boundary within the Nillumbik Shire.

Part 2 – Controls Applying to Fireworks

Introduces a permit trigger for the discharge of fireworks from private property outside the Urban Growth Boundary.

Sets out information and assessment requirements for the consideration of a fireworks permit.

Introduces a prohibition for the issue of a fireworks permit during certain periods of the year.

Part 3 – Administration

Introduces administration guidelines for the Fireworks Local Law 2019

Part 4 – Enforcement

PROHIBITION OF FIREWORKS LOCAL LAW 2019

Notice is hereby given that Nillumbik Shire Council intends to make the following Local Law under Section 111(1) of the Local Government Act 1989.

TITLE:

Prohibition of Fireworks Local Law 2019

PURPOSE:

The objective of this Local Law is to prohibit the discharge of fireworks in certain parts of the municipality:

  • to restrict activities in a bushfire prone rural environment that can impact on the health and wellbeing of residents, specifically those who have experienced catastrophic bushfires;
  • to reduce the risk of danger and injury to animals and wildlife arising from the discharge of fireworks;
  • to address nuisance, amenity and environmental impacts of fireworks activities; and
  • apply standards that address safety matters directed at reducing risk to the community.

GENERAL PURPORT:

Part 1 – Preliminary

This Local Law is the Fireworks Local Law 2019 and is made under Part 5 of the Local Government Act 1989.

This Local Law applies to land outside of the urban growth boundary within the Nillumbik Shire.

Part 2 – Prohibition of Fireworks

A person must not discharge any fireworks on or from private property outside the urban growth boundary

Part 3 – Administration

Introduces administration guidelines for the Prohibition of Fireworks Local Law 2019

Part 4 – Enforcement

A copy of the Draft Fireworks Local Law 2019 and Draft Prohibition of Fireworks Local Law 2019 is available from Nillumbik Shire Offices, Civic Drive Greensborough. Documentation is also available at Participate Nillumbik (https://participate.nillumbik.vic.gov.au/fireworks-local-law ).

Council will consider written submissions received by 07 August 2019 and lodged through the “Enquiries and Submissions” tab at https://participate.nillumbik.vic.gov.au/fireworks-local-law, or in writing addressed to the Manager Community Safety and Amenity, Nillumbik Shire Council, Civic Drive (PO Box 476) Greensborough Victoria 3088 in accordance with section 223 of the Local Government Act 1989.

Any person lodging a written submission may request to be heard in support of their submission and shall be entitled to be heard in person or by a person acting on their behalf before a meeting of the Future Nillumbik Committee on 10 September 2019.
