Planning Scheme Amendment C117

Council is committed to listening to our community and valuing our public open space.

Council has resolved to rezone 15 parcels of Council owned land to the Public Park and Recreation Zone (PPRZ).

The reason and purpose of the rezoning is to formally confirm the status of the land parcels as public open space, providing clarity about the future intent for the land.

To rezone land, Council is required to amend the Nillumbik Planning Scheme. The amendment process allows the community to make submissions to the proposal.

The Nillumbik Shire Council has prepared Amendment C117 to the Nillumbik Planning Scheme.

The land affected by the amendment is:

  • Lot 1, 44 Graysharps Road, Hurstbridge
  • 60 David Hockney Drive,
  • 14 Ripon Close, Diamond Creek
  • 120 Arthur Street
  • 17 A Ruskin Court, Eltham
  • 12 The Eyrie, Eltham
  • 26 Renshaw Drive, Eltham
  • 20A Henry Street, Eltham (Roseo Street on title)
  • 34 Glen Park Road, Eltham
  • 46 Symon Crescent, Greensborough
  • 8-9 Cosham Court, Greensborough
  • 4 Raglan Court, Research
  • 34 Raglan Road, Research (Doney Road on title)
  • 36-44 and 44b Civic Drive
  • Lot 2 32-34 Civic Drive

The amendment proposes to rezone 15 parcels of Council owned land to Public Park and Recreation Zone (PPRZ); delete the Design and Development Overlay – Schedule 5 (DDO5) and Development Plan Overlay – Schedule 7 (DPO7) from the land at Lot 1, 44 Graysharps Road, Hurstbridge; amend the DDO5 to delete Map 1; delete the DPO7; and amend the Schedule to Clause 72.03 to update the list of maps forming part of the Nillumbik Planning Scheme.

You may inspect the amendment, any documents that support the amendment and the explanatory report about the amendment, free of charge, at the following locations:

  • during office hours, at the office of the planning authority, Nillumbik Shire Council, Civic Drive, Greensborough VIC 3088.
  • at the Department of Environment, Land, Water and Planning website www.delwp.vic.gov.au/public-inspection.

Any person who may be affected by the amendment may make a submission to the planning authority about the amendment. Submissions must be made in writing giving the submitter’s name and contact address, clearly stating the grounds on which the amendment is supported or opposed and indicating what changes (if any) the submitter wishes to make.

Name and contact details of submitters are required for council to consider submissions and to notify such persons of the opportunity to attend council meetings and any public hearing held to consider submissions.

The closing date for submissions is 20 September 2019. A submission must be sent to Strategic Planning, Nillumbik Shire Council, Civic Drive (PO Box 476) Greensborough 3088 or lodged through the “Enquiries and Submissions” tab at:  https://participate.nillumbik.vic.gov.au/AmendmentC117

The planning authority must make a copy of every submission available at its office for any person to inspect free of charge for two months after the amendment comes into operation or lapses.
