Apply for a siting variation 

Report and consent refers to aspects of your building design that do not meet the siting requirements set out under the applicable building regulation(s) in Part 5. In these situations you have the option of applying to Council (the ‘reporting authority’) for report and consent or amending the design to comply with these regulations.

Please discuss with the relevant building surveyor engaged for the issue of the building permit before making an application.

The application fee is $290.40 per regulation and once the completed application has been lodged an invoice will be sent to your nominated email address for payment online.

Note
Neighbours comments(PDF, 608KB) are required where the variation sought is in relation to a reduction in setback or if the proposed variation of the Building Regulations may impact the amenity of the adjoining property. 

How to apply

  • Complete online application form make sure you have title, neighbours comments (if applicable) and design plans to be uploaded at the end of the application.

Apply for Report and Consent to build on flood prone land (Regulation 153 or 154)

An application for Council’s Report and Consent is required should the proposed building work be located on land identified as subject to flooding (Regulation 153) or Designated land or works (Regulation 154). There are circumstances where an application for Report and consent may not be required. In this regard it is important that you discuss your application with the relevant building surveyor prior to making an application.  

The application fee is $290.40 per regulation and once the completed application has been lodged an invoice will be sent to your nominated email address for payment online.

To find out if your property is identified as liable to flooding or within designated land or works you can obtain a property information certificate online.

Apply for Report and Consent (Protection of the Public Regulation 116)

In accordance with Regulation 116 of the Building Regulations 2018, precautions being constructed over the street, road or footpath must be taken before and during building work to protect the safety of public as part of the building permit process.

The application fee is $290.40 plus occupation fee calculated at $5 per m2 per day (min $200 per week), once the completed application has been lodged an invoice will be sent to your nominated email address for payment online.

Please allow a minimum processing time of 10 business days. 

 

How to apply

  • Complete and sign application form(PDF, 488KB)
  • Provide written statement from relevant building surveyor approving the method of protection of the public
  • Copy of public liability
  • Traffic management plan
  • Detailed site plan that shows the location of the proposed hoarding/temporary fencing (including method of bracing to prevent collapse)
