Operating a temporary or mobile food business

Temporary and mobile food businesses are those that are not permanently based at a fixed location.

These can include:

  • food stalls and tents at markets or festivals
  • food trucks, vans or carts
  • private drinking water carts
  • food vending machines
  • sausage sizzles and cake stalls.

If your food truck or van parks permanently at one location and doesn’t move, it may need to be registered as a fixed food premises.

How to apply

To operate a temporary or mobile food business in Victoria, you must:

Step 1.Register

Register your business with FoodTrader.

FoodTrader is the state-wide registration system for temporary and mobile food businesses.

Step 2.Lodge a Statement of Trade

You must submit a Statement of Trade (SOT) through FoodTrader each time you trade, to inform the relevant councils when and where you will be operating.

Note:

  • Submit your SOT at least 48 hours before trading.
  • There is no fee for submitting a SOT.
  • A SOT is not required if you’re catering a private event, such as a wedding or birthday.

Allow at least 21 days between lodging your registration and your intended start date to ensure there is enough time for approval.

Step 3.After you apply

Once you register on FoodTrader, the system will:

  • identify your principal council and notify them of your application
  • assign a classification to your business based on your food handling activities
  • determine whether you need to register or notify your local council.

Operating on Council land

If you plan to trade on Council-owned land, such as a park or footpath, you may also need to apply for a Street Trading Permit through Nillumbik Shire Council’s Community Safety team.
